Ownership structures - the tax side
Property can be held personally, jointly, in a company, a look-through company or a trust. Each is taxed differently - for example, the company tax rate is 28%, and trustee income over $10,000 is taxed at 39% from the 2024-25 year. We explain the tax effect of each option. Legal ownership and asset protection need a lawyer, and we work alongside yours.
Thinking of selling?
Talk to us before you sign. Residential property sold within 2 years may be taxed under the bright-line test (sales from 1 July 2024), and other rules can tax sales where you bought with an intention to resell, or where you are in the property business. A check before you sell helps you understand any tax in advance.
Interest deductions in 2026
From 1 April 2025 investors can again claim 100% of interest on residential rental loans. Only interest on money used for the rental can be claimed, so where a loan is used for more than one purpose the interest has to be split. We work this out in your accounts.
Common questions
Is it better to own rentals in a company or a trust?
It depends on your income, plans and family situation. We show you the tax side; we recommend legal advice before you change ownership.
Can losses from one rental offset profit from another?
Generally yes. By default, Inland Revenue treats your residential rentals as one portfolio, so excess deductions from one can be used against rental income from another. You can choose to treat some properties individually.
Do you give investment or mortgage advice?
No. We provide accounting and tax services. For lending or investment decisions talk to a licensed adviser.
Can you take over from my current accountant?
Yes. We request your records and link as your tax agent - you do not have to do the paperwork.
